These Terms of Service govern your use of soothi.com and any purchase you make from it. The site is operated by Sanskrit, DBA Soothi, a California business located at 2744 E 11 Street, Unit D2, Oakland, CA 94601 ("Soothi," "we," "us," "our").

By visiting our site or placing an order, you agree to these terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate.

2. Products

Our products are handmade. Variation in color, texture, grain, and finish is a characteristic of the materials and the process, not a defect. Product photography is representative, and the item you receive may differ slightly in appearance.

We describe materials and dimensions as accurately as we can. We do not warrant that product descriptions, photographs, or other content on the site are complete, current, or error-free.

3. Pricing and availability

All prices are in US dollars unless stated otherwise. We may change prices, discontinue products, or limit quantities at any time without notice.

If an item is listed at an incorrect price or with incorrect information, we may cancel or refuse any order placed for it, including after an order confirmation has been sent. If we cancel an order you have already paid for, we will refund you in full.

4. Orders

Your order is an offer to buy. We may accept or decline any order, and we may limit or cancel quantities purchased per person, per household, or per order. An order confirmation email is an acknowledgment that we received your order, not an acceptance of it.

5. Custom and personalized orders

Custom and personalized items, including debossed covers and custom interior printing, are made to your specification and are final sale. Once production has started, these orders cannot be canceled, returned, or exchanged.

You are responsible for the accuracy of the text, artwork, and specifications you supply. Please review your proof carefully. We produce from the approved proof.

By submitting artwork, a logo, or other material for a custom order, you confirm that you have the right to use it and you permit us to reproduce it for the purpose of fulfilling your order.

Minimum quantities, lead times, and sampling charges for custom orders are quoted at the time of the order and form part of the agreement between us.

6. Payment

Payment is processed by our payment providers. You confirm that you are authorized to use the payment method you provide. We do not store full payment card numbers.

7. Shipping and delivery

Shipping terms, delivery estimates, and the handling of lost or stolen packages are set out in our Shipping Policy, which is part of these terms. Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery to the carrier.

For international orders, you are the importer of record. You are responsible for any duties, taxes, and customs charges, and for compliance with the import rules of your country. We cannot control these charges and we do not refund them.

8. Returns

Returns and refunds are governed by our Return and Refund Policy, which is part of these terms.

9. Intellectual property

The content on this site, including text, photography, graphics, logos, and product designs, belongs to Soothi or our licensors and is protected by copyright and trademark law. You may not copy, reproduce, or use it for commercial purposes without our written permission.

10. Content you submit

If you submit a review, photograph, comment, or other content to us or to our social channels, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with our business. You are responsible for the content you submit, and you confirm it does not infringe anyone's rights.

We may edit or remove submitted content at our discretion. We are not obliged to keep any content you submit confidential.

11. Acceptable use

You agree not to use the site for any unlawful purpose, to interfere with its operation or security, to scrape or harvest data from it, to introduce malicious code, or to impersonate any person. We may terminate your access for any breach of these terms.

12. Third-party links

Our site may link to third-party sites and services we do not control. We are not responsible for their content, products, or privacy practices. Your dealings with them are between you and them.

13. Disclaimer of warranties

The site and the products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.

14. Limitation of liability

To the fullest extent permitted by law, Soothi and its owners, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or from any product purchased through it.

Our total liability for any claim relating to a product or to the site will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold Soothi harmless from any claim or demand, including reasonable attorneys' fees, arising from your breach of these terms or your violation of any law or third-party right.

16. Privacy

Our Privacy Policy and Cookie Policy explain how we collect and use personal information. They are part of these terms.

17. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Alameda County, California, and you consent to the jurisdiction of those courts.

18. Severability

If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full effect.

19. Changes to these terms

We may update these terms at any time by posting a revised version on this page. The date at the top shows the latest version. Your continued use of the site after a change means you accept the revised terms.
